Most of the time, when you install Arduino on Mac OS X, the drivers are installed automatically. You agree that this Agreement conveys a limited license to use Music Tribe's Intellectual Property Rights, solelyas part of the Software (and not independently of it), and only for the effective Term of the license granted toyou hereunder. Accordingly, your use of any of Music Tribe's Intellectual Property Rights independently of theSoftware or outside the scope of this Agreement shall be considered an infringement of Music Tribe'sIntellectual Property Rights. This shall not limit; however, any claim Music Tribe may have of a breach ofcontract in the event you breach a term or condition of this Agreement. You shall use the highest standard ofcare to safeguard all Software (including all copies thereof) form infringement, misappropriation, theft, misuse,or unauthorized access. Except as expressly granted in this Agreement, Music Tribe reserves and shall retain allrights, title, and interest in the Software, including all copyrights and copyrightable subject matter, trademarksand trademark able subject matter, patents and patentable subject matter, trade secrets, and other intellectualproperty rights, registered, unregistered, granted, applied-for, or both now in existence and that may becreated, relating thereto.
The party providing the Third-Party Software is responsible for any warranty or liability related arising from theThird-Party Software. MG-IP is not responsible in any way for the Third-Party Software or your use thereof.
This Agreement will terminate immediately, without prior notice from Music Tribe, if you fail to comply withany provision of this Agreement. You may also terminate this Agreement by deleting the Software and allcopies thereof from your computer.
Without limiting the foregoing, neither Music Tribe nor any of Music Tribe's provider makes any representationor warranty of any kind, express or implied: (i) as to the operation or availability of the Software, or theinformation, content, and materials or products included thereon; (ii) that the Software will be uninterruptedor error-free; (iii) as to the accuracy ,reliability, or currency of any information or content provided through theSoftware; or (iv) that the Software, its servers, the content, or emails sent from or on behalf of Music Tribe arefree of viruses, scripts, trojan horses, worms, malware, time bombs or other harmful components.
By continuing to access or use our Software after any revisions become effective, you agree to be bound by therevised terms. If you do not agree to the new terms, you are no longer authorized to use the Software.
We reserve the exclusive right to make changes to this Agreement from time to time. Your continued access toand use of the software constitutes your Agreement to be bound by, and your acceptance of, the terms andconditions posted at such time. You acknowledge and agree that you accept this Agreement (and anyamendments thereto) each time you load, access, or use the software.
Subject to the terms of this Agreement, you may use the Image only for editorial use or as an authorized distributor or reseller. This right to use is personal to you and is not transferable by you to another party. The Image cannot be used to promote or sell any product or technology (such as on advertising, brochures, book-covers, stock photos, t-shirts, or other promotional merchandise) other than authentic Music Tribe IP Ltd.
